TX Machine Rentals Rental Agreement

1. Parties and Equipment
This Rental Agreement ("Agreement") is entered into between TX Machine Rentals ("Company") and the customer identified during registration ("Customer").
The Company agrees to rent washer and/or dryer equipment ("Equipment") to Customer subject to the terms and conditions of this Agreement.
By accepting this Agreement electronically, Customer agrees to be legally bound by all terms contained herein.
2. Ownership of Equipment
All Equipment provided under this Agreement remains the sole and exclusive property of TX Machine Rentals at all times.
This Agreement transfers no ownership rights to Customer. Customer receives only a temporary right to possess and use the Equipment during the rental period.
Customer shall not sell, transfer, pledge, sublease, relocate, abandon, conceal, dispose of, or allow any third party to claim ownership of the Equipment.
3. Rental Term
This Agreement is a month-to-month rental agreement that automatically renews each month until terminated.
Customer may terminate this Agreement by providing at least thirty (30) days written notice.
TX Machine Rentals may terminate this Agreement immediately for: Non-payment; Failed or declined payment methods; Breach of this Agreement; Misuse or damage to Equipment; Fraud or misrepresentation; Failure to provide access to Equipment; Abandonment of the premises; or any action that threatens the Company's ownership or recovery of Equipment.
Upon termination, Customer's right to possess the Equipment immediately ends.
4. Payments
Rental payments are due on the agreed billing date.
Customer authorizes recurring charges to the payment method provided during registration.
Any payment not received within five (5) days after the due date may be assessed a late fee of up to $25.
Customer is responsible for maintaining a valid payment method and current billing information at all times.
Failure of a payment method does not relieve Customer of payment obligations under this Agreement.
5. Default
Customer shall be considered in default if: Any payment remains unpaid more than five (5) days after its due date; Customer fails to maintain a valid payment method; Customer breaches any term of this Agreement; Customer refuses to return Equipment upon demand; Customer conceals, relocates, transfers, or interferes with recovery of Equipment.
Upon default: TX Machine Rentals may immediately terminate this Agreement; All unpaid balances become immediately due and payable; TX Machine Rentals may demand immediate return of Equipment; Customer's right to possess the Equipment immediately ceases.
6. Return of Equipment
Upon termination, cancellation, or default, Customer shall immediately make the Equipment available for pickup.
Customer agrees not to interfere with, delay, conceal, relocate, or otherwise prevent recovery of Company-owned Equipment.
Failure to return Equipment after demand may result in legal action seeking possession of the Equipment, unpaid rental charges, court costs, filing fees, service fees, and other remedies available under Texas law.
7. Loss, Theft, Damage, Replacement Cost, or Failure to Return Equipment
Customer is responsible for damage caused by misuse, negligence, abuse, unauthorized repairs, improper operation, unauthorized relocation, failure to follow manufacturer instructions, or failure to provide reasonable care of the Equipment.
Customer shall be responsible for the reasonable repair cost or replacement value of Equipment that is lost, stolen, destroyed, intentionally damaged, abandoned, withheld, concealed, transferred, sold, moved without authorization, or not returned after demand by TX Machine Rentals.
For purposes of this Agreement, estimated replacement values may include, but are not limited to: Standard washer and dryer set: up to $800; Stackable washer and dryer unit: up to $1,200; Premium/front-load washer and dryer set: up to $1,500; Individual washer or dryer: up to $500 each; Hoses, cords, venting, brackets, stacking kits, platforms, or accessories: actual replacement cost.
The listed amounts are estimates and do not limit TX Machine Rentals from seeking the actual reasonable cost to repair, replace, recover, or restore the Equipment when supported by documentation.
Customer agrees that continued possession of Equipment after termination, default, cancellation, or demand for return does not transfer ownership rights to Customer or any other person.
Customer shall also be responsible, to the extent permitted by Texas law, for reasonable costs incurred by TX Machine Rentals to enforce this Agreement or recover Company-owned Equipment, including court costs, filing fees, service fees, collection expenses, skip-tracing expenses, recovery labor, transportation costs, and costs associated with locating, recovering, repairing, cleaning, or replacing Equipment.
8. Access for Pickup and Recovery
Customer agrees to provide safe and reasonable access for delivery, maintenance, inspection, pickup, and recovery of Equipment.
Customer shall keep the Equipment at the installation address listed in this Agreement unless prior written approval is obtained from TX Machine Rentals.
Customer agrees to notify TX Machine Rentals within forty-eight (48) hours of: Any move; Eviction notice; Change of address; Change in occupancy; or any circumstance affecting the location of the Equipment.
Upon termination, default, abandonment of the premises, eviction, move-out, or demand for return of the Equipment, Customer agrees to make the Equipment immediately available for pickup.
Customer expressly authorizes TX Machine Rentals to communicate and coordinate with property owners, landlords, apartment management companies, leasing offices, property managers, maintenance personnel, and other authorized representatives of the installation property for the limited purpose of locating, identifying, scheduling, and recovering Company-owned Equipment.
Customer acknowledges that the Equipment remains the sole property of TX Machine Rentals and authorizes property management to release Company-owned Equipment to TX Machine Rentals when legally permitted and when the Equipment has been abandoned, left behind after move-out, or otherwise remains on the property following termination of this Agreement.
Failure to provide access to Company-owned Equipment after demand for return constitutes a material breach of this Agreement.
9. Maintenance and Repairs
TX Machine Rentals is responsible for maintenance and repairs resulting from normal wear and tear.
Customer shall promptly report any malfunction, damage, or operating issue.
Unauthorized repairs, modifications, or alterations are prohibited without prior written approval from TX Machine Rentals.
TX Machine Rentals may repair, replace, or exchange Equipment at its discretion.
10. Limitation of Liability
TX Machine Rentals is not responsible for damage to Customer's clothing, personal property, plumbing systems, electrical systems, water lines, flooring, walls, or other property except where required by law.
Customer is responsible for maintaining any renter's insurance they deem appropriate.
11. Collection Costs and Enforcement
To the extent permitted by Texas law, Customer agrees to reimburse TX Machine Rentals for reasonable costs incurred in enforcing this Agreement, including: Court costs; Filing fees; Service fees; Collection expenses; Skip-tracing expenses; and Costs associated with recovering Company-owned Equipment.
12. Governing Law and Venue
This Agreement shall be governed by and construed under the laws of the State of Texas.
Any legal action arising from this Agreement may be brought in the appropriate court located in the county where the Equipment was delivered, where Customer resides, or as otherwise permitted by Texas law.
13. Electronic Acceptance
Customer agrees that electronic acceptance of this Agreement constitutes a legally binding signature.
Customer acknowledges that they have read, understood, and agreed to all terms and conditions contained in this Agreement.
By checking the acceptance box and submitting registration, Customer acknowledges receipt of this Agreement and agrees to be legally bound by its terms.
